Can Kelvin Kampamba Exit His Libyan Club as Violence Escalates in Tripoli?

With violence surging in Tripoli, questions are mounting over whether Zambian midfielder Kelvin Kampamba can legally terminate his contract with Libyan side Al-Madina.

Various Chipolopolo supporters have urged midfielder Kelvin Kampamba to ditch Libyan side Al–Madina following the escalating violence in Tripoli.

The Ministry of Youth, Sport and Arts has begun a process to safely evacuate the skilful midfielder after he recently issued a distress call over his safety.

While evacuation efforts are underway, Kampamba’s future remains uncertain as contractual obligations and safety concerns collide.

Even though Kampamba returns home, he remains contracted to the club and ideally should return if normalcy returns in the town. However, many people want him to cut ties with the club.

So what league options does Kampamba have in the meantime?

Mutual Termination with Al-Madina

One possibility is negotiating an early exit with his club. If both parties agree, Kampamba can terminate his contract voluntarily. However, this may involve financial settlements or forfeiting certain benefits.

According to Transfermarkt, he is contracted to the club until the end of the season.  

Activate Force Majeure Clause

Most contracts contain a force majeure clause; Kampamba’s contract should be no different. A force majeure clause is a contract provision that frees one or both parties from obligations when unforeseeable, uncontrollable events occur, making fulfilment impossible or dangerously unreasonable.

Should the current instability escalate, it would be wise for him to invoke it, because for as long as there is violence, his club will be unable to fulfil contractual obligations.

The beauty of this is that he could leave without penalty.

FIFA’s Player Safety Provisions

FIFA’s regulations on player protection may offer a legal path for Kampamba’s departure. Previously, FIFA has allowed players to leave clubs in war zones under special exemptions.

Should Zurich deem Tripoli’s crisis an unsafe environment for footballers, Kampamba could receive authorization to terminate his contract.

Waiting Until Contract Expiry

Kampamba’s contract runs until the end of the season. If he chooses to stay, he can depart legally when it expires. In the meantime, he would not be able to register for any other club.
